In Florida, the Department of Business and Professional Regulation (DBPR) licenses asbestos contractors, consultants and businesses, and the Department of Environmental Protection (DEP) or its local program receives renovation and demolition notices at least 10 working days ahead for projects over the NESHAP thresholds. Notification before renovation or demolition
- For projects removing asbestos-containing material above the NESHAP thresholds, notice must be submitted at least 10 working days before the project start date. Source
- The building owner and/or operator must notify the applicable compliance office, which is the DEP district or local program office for the project's location. Source
- Notices and project fees can be filed in the DEP Business Portal under Submit, then Registration/Notification, then Notice of Renovation or Demolition. Source
- Effective March 23, 2025, DEP revised Florida's Asbestos Program Rule (62-257, F.A.C.) to update definitions, clarify the notification procedure and simplify the fee schedule. Source
Homeowners and private residences
- DEP's program excludes buildings that meet the residential exemption criteria in the Asbestos NESHAP. Source
- Florida's asbestos licensing law exempts moving, removal or disposal of asbestos-containing materials on a residential building where the owner occupies the building, the building is not for sale or lease, and the work follows the owner-builder limitations. The owner must personally appear and sign the building permit application. Source
An exemption from licensing or notice is not a safety finding. EPA advises leaving undamaged material alone and having a trained professional sample anything you plan to disturb. See do I need asbestos testing before renovating?

The federal baseline
State rules sit on top of the federal Asbestos NESHAP. These points apply nationwide.
- Before a covered demolition or renovation starts, the owner or operator must thoroughly inspect the affected facility for asbestos, including Category I and Category II nonfriable material. Source
- The full removal and work-practice requirements apply when the regulated asbestos-containing material (RACM) involved totals at least 260 linear feet on pipes, 160 square feet on other components, or 35 cubic feet where it could not be measured beforehand. Source
- Written notice of intent is due at least 10 working days before asbestos stripping or removal work, or any other covered activity, begins. Source
- The owner or operator must notify the delegated agency before any demolition. Renovations need notice only when they involve the threshold amount of regulated asbestos-containing material. Source
- The work practice standards cover demolitions and renovations of all facilities except residential buildings with four or fewer dwelling units. A home demolished or renovated as part of a commercial or public project is not exempt. Source
