New York asbestos rules: licensing, notices and homeowner exemptions
Built from official New York and federal agency pages. Checked November 2026.
New York's Industrial Code Rule 56, enforced by the State Department of Labor (DOL), requires an asbestos survey by a certified New York State Asbestos Inspector before interior and exterior renovation, remodeling, repair and demolition. Asbestos must be abated by licensed contractors using certified workers. The only homeowner exemption is an owner-occupied single-family home where the owner does the work. New York City adds its own DEP requirements.
Licensing
NYS Department of Labor (ICR 56)
Advance notice
Large projects file with DOL; NYC projects file with DEP at least 7 days ahead

Who licenses asbestos work in New York
New York State Department of Labor, Asbestos Control Bureau.
- Anyone who does not hold an asbestos handling license, including general contractors, plumbers, electricians and roofers, may not disturb or remove asbestos. Asbestos must be abated by licensed asbestos contractors using certified asbestos workers, except in owner-occupied single-family homes where the owner does the work. Source
- For license or certification questions, the Asbestos Control Bureau lists the License and Certification Unit at (518) 457-2735. Source

Asbestos survey before renovation or demolition
- An asbestos survey must be performed before all interior and exterior renovation, remodeling, repair and demolition work, by a certified New York State Asbestos Inspector who identifies all asbestos-containing material that may be disturbed. Source
- Condemned, structurally unsound buildings cannot be surveyed; they are assumed to contain asbestos and must be demolished by licensed asbestos contractors. Source
Notification before renovation or demolition
- The Asbestos Control Bureau's rules include filing notifications for large projects, through its Asbestos Notifications Online system. The Bureau's page does not state the filing deadline, so ask the Bureau or your contractor. Source
- In New York City, DEP approval is required before asbestos is disturbed, and projects must be filed with DEP at least 7 days before the start date. Source
Homeowners and private residences
- A homeowner may do asbestos abatement only when the home is a single-family dwelling, it is occupied or going to be occupied by the homeowner, and the work is done solely by the homeowner. Source
- A structure slated for demolition is not occupied and is not eligible. Corporations, contractors and flippers who will sell or rent the home are not considered owners. A second home qualifies only if it is not rented full or part time. Source
- DOL has no jurisdiction once asbestos waste enters the waste stream; transport and disposal fall under the NYS Department of Environmental Conservation and the landfill being used. Source
- DOL recommends that asbestos-containing materials be removed by licensed asbestos contractors that employ certified workers, and recommends a licensed asbestos inspector to sample suspect materials. Source
An exemption from licensing or notice is not a safety finding. EPA advises leaving undamaged material alone and having a trained professional sample anything you plan to disturb. See do I need asbestos testing before renovating?
Local programs in New York
- In New York City, building owners must have an asbestos survey done by a DEP-certified asbestos investigator. DEP cites penalties of $1,200-$10,000 per infraction for failing to survey or to use a licensed contractor who files a project notification. DEP does not make referrals. Source
The federal baseline
State rules sit on top of the federal Asbestos NESHAP. These points apply nationwide.
- Before a covered demolition or renovation starts, the owner or operator must thoroughly inspect the affected facility for asbestos, including Category I and Category II nonfriable material. Source
- The full removal and work-practice requirements apply when the regulated asbestos-containing material (RACM) involved totals at least 260 linear feet on pipes, 160 square feet on other components, or 35 cubic feet where it could not be measured beforehand. Source
- Written notice of intent is due at least 10 working days before asbestos stripping or removal work, or any other covered activity, begins. Source
- The owner or operator must notify the delegated agency before any demolition. Renovations need notice only when they involve the threshold amount of regulated asbestos-containing material. Source
- The work practice standards cover demolitions and renovations of all facilities except residential buildings with four or fewer dwelling units. A home demolished or renovated as part of a commercial or public project is not exempt. Source
